FACTS/CONTENTIONS:
According to plaintiffs: On March 8, 2001, Defendant James Gallimore, drove his employer’s vehicle under the influence of alcohol and collided with the rear of plaintiffs’ vehicle, causing plaintiffs’ vehicle to spin out of control and hit a concrete divider wall on the 405 N/B San Diego FWY. Defendant then continued to collide with two other vehicles. At the time of the collision, plaintiffs were visiting from Michigan for Mr. Belanger to participate in a Motor-Cross Bicycle Racing Copetition. As a result of the collision, Mrs. Belanger, a 51 year-old Accounts Executive sustained severe injuries including a herniated Disc at C6-C7 and cognitive problems. Mr. Belanger, a Product Designer sustained only soft tissue injuries. Liability was not disputed at the mediation.
