Injury: Traumatic brain damage; herniated disks in neck and low back; depression. Result: $750,000 (settlement)
Area: Los Angeles County, California Plaintiff Attorney: Defendant Attorney: Plaintiff alleged lifetime disabling orthopedic and traumatic brain damage injuries due to accident. Defendant contended that, despite the apparent severity of the collision, plaintiff fortunately sustained only soft-tissue orthopedic spinal injuries. Facts: 7/27/01, plaintiff Gina Weber, age 36, was hit head-on by the crossover car of defendant Michael Roberts on Avenue P in Palmdale. Plaintiff's gas company pickup cab was crushed, and the vehicle rolled over twice. Defendant was arrested for driving under the influence after bystanders restrained him from fleeing the scene. Defendant was a methadone patient who had allegedly consumed alcohol (two beer cans found inside his car) and passed out, crossing over the centerline. Defendant had a history of multiple felony convictions, at least one prior methadone/alcohol-caused collision, and had also suffered a disabling stroke from a prior heroin overdose. He pled no contest to DUI for his accident. Settlement Date: July 26, 2005 |
