Facts: Plaintiff claimed he was struck by a bus while standing on a street corner. The plaintiff was Manuel Perez. The defendant was Los Angeles County Metropolitan Transportation Authority ('LACMTA'). An LACMTA bus was heading westbound on 8th Street and turned right to go northbound on Hill Street. Plaintiff claimed he was standing on the northeast corner of 8th Street and Hill Street when the bus drove up on the curb and ran over his foot. Defendant contended that, although there was an LACMTA bus in the area, it did not strike plaintiff. In fact, if plaintiff was struck by a bus, it was not an LACMTA bus.
