Area: Los Angeles County, California Plaintiff Attorney: Defendant Attorney: Facts: According to plaintiff: On the evening of October 31, 2003, plaintiff Annabell Ashcraft, a tenant at defendant Creekside Senior Apartment Community, left the recreation room where she was playing bingo during a break. She was in her electric wheelchair, and her destination was a common area bathroom. The light switch in the bathroom was on a timer, and the light was on when she stepped into the bathroom. After she finished using the toilet and was pulling her pants up, the light went off, causing the bathroom to be pitch dark. In an effort to find the door, plaintiff lost her balance and fell, which resulted in a fracture of her right hip and right humerus. From the scene, she was taken to Parkview Community Hospital where open reduction and internal fixation of the right hip fracture approximately five years prior to this injury. As such, her ambulation was significantly reduced because of this accident. Settlement Date: March 17, 2005 |
